NUGG Mobility Rider Rental Agreement and Terms of Service

Welcome to NUGG Mobility!
By accessing, renting, or using our services ("Services"), you ("Rider," "User," "You," or "Your") agree to comply with and be bound by this Rental Agreement and Terms of Service ("Agreement"). Please read carefully before proceeding.

1. Definitions

  • "NUGG Mobility" including its affiliates, employees, contractors, and agents.

  • "Services" refer to the rental, use, and operation of NUGG Mobility electric scooters, bicycles, and related equipment ("Equipment").

  • "Rider" or "User" refers to any individual who accesses, rents, or uses the Services.

2. Eligibility Requirements

To rent and operate Equipment, you must:

  • Be at least 18 years old.

  • Possess a valid, government-issued photo ID.

  • Maintain a valid credit or debit card for payment.

  • Be physically capable of operating the Equipment safely and responsibly.

3. Rental Terms

  • Rental Period: Your rental begins when you unlock the Equipment and ends when you properly lock and park it at an authorized NUGG Mobility location.

  • Rental Fees: Rental fees are charged based on usage time or pricing displayed within the NUGG Mobility app or website.

  • Payment Authorization: By renting Equipment, you authorize NUGG Mobility to charge your payment method for all associated fees, including but not limited to rental fees, late fees, damage charges, or replacement costs.

4. Rider Responsibilities

  • Safety First: Riders are strongly encouraged to wear a helmet and must comply with all local, state, and federal traffic laws.

  • Proper Use: Use the Equipment for personal transportation only. No racing, tricks, stunts, or towing of other people or objects.

  • Return Condition: Return Equipment in the same condition it was rented.

  • Reporting Issues: Inspect Equipment before use and report any malfunction, damage, or safety issues immediately through the NUGG Mobility app.

5. Prohibited Activities

You agree NOT to:

  • Operate Equipment under the influence of alcohol, drugs, or any impairing substances.

  • Allow others to use Equipment under your account.

  • Use Equipment for commercial delivery services or illegal purposes.

  • Modify, disassemble, or tamper with the Equipment or its components.

6. Assumption of Risk and Liability

  • Acknowledgment of Risk: You acknowledge that operating electric scooters and bicycles carries inherent risks of accidents, bodily injury, death, and property damage.

  • Release and Indemnity: You release, indemnify, and hold harmless NUGG Mobility and any associated facilities/providers from any claims, damages, injuries, or liabilities arising from your mistakes, misuse, use of the Services or Equipment.

7. Damage, Loss, and Theft

  • Responsibility: You are responsible for the Equipment and agree to pay for any loss, theft, or damage incurred during your rental period.

  • Charges: In cases of Equipment loss, theft, or irreparable damage, you may be charged up to the full replacement value as listed in the NUGG Mobility app or website.

8. Privacy and Data Use

  • Personal Data: By using our Services, you consent to NUGG Mobility collecting, storing, and using your personal information as described in our Privacy Policy.

  • Purpose: Your data is used to process transactions, improve Services, enforce compliance, and communicate relevant updates.

9. Suspension and Termination

NUGG Mobility reserves the right to suspend, block, or terminate your access to the Services at its sole discretion for violations of this Agreement, misuse of Equipment, or unsafe behavior.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Equipment is rented.

11. Amendments

NUGG Mobility reserves the right to amend this Agreement at any time. Updates will be posted in the app or website, and continued use of the Services constitutes acceptance of any changes.

Acknowledgment

By renting or using NUGG Mobility’s Equipment and Services, you confirm that you have read, understood, and agreed to be bound by the terms and conditions of this Rider Rental Agreement and Terms of Service.
